Members of the firm have a wide variety of experience in environmental matters. Although the current focus is on litigation to determine financial liability for the cleanup of hazardous substances under the Comprehensive Environmental Response, Cleanup and Liability Act (CERCLA), the firm also has experience with litigation involving the management of hazardous waste (RCRA), environmental review requirements for government actions (CEQA), and leaking underground storage tanks. Members also have experience in water rights litigation, water quality litigation, Endangered Species Act litigation, and the public trust doctrine.
The firm also represents parties in connection with regulatory agency oversight with respect to the cleanup and remediation of hazardous substances.
The firm’s personal injury litigation practice ranges from the defense of complex medical malpractice defense litigation to auto accident and slip and fall cases. Other significant areas include product liability defense on behalf of major manufacturers, toxic tort litigation, including contaminated groundwater exposure and mold exposure litigation, and premises liability litigation.
Our lawyers have also successfully represented plaintiffs in personal injury litigation, obtaining significant settlements and recoveries for injured persons and victims of elder abuse and neglect.
Our lawyers have tried a wide variety of employment cases, in both state and federal courts, involving allegations of harassment and discrimination based on race, sex, religion, disability, sexual orientation, and other characteristics, as well as allegations of failure to accommodate disabilities, wage and hour violations, and administrative claims filed with government entities like the California Department of Fair Employment and Housing and the federal Equal Employment Opportunity Commission. We have resolved a substantial number of cases via binding arbitration, mediation and other forms of alternative dispute resolution, and have obtained summary judgments and gotten cases dismissed without the need for jury trials in a large number of discrimination, harassment, and failure-to-accommodate cases.
Our firm defends manufacturers, dealers, repair centers, and retailers against consumer warranty complaints under California’s Song-Beverly Consumer Warranty Act, the federal Magnuson-Moss Warranty Act, and the California Commercial Code and Uniform Commercial Code. We also provide representation to manufacturers and dealers in administrative proceedings before the New Motor Vehicle Board.
We represent real estate professionals and residential and commercial property owners in a variety of real property disputes. Our firm defends real estate brokers and agents for alleged professional negligence and bring actions to recover unpaid commissions. We also represent residential and commercial property owners in nuisance, trespass, easement and boundary, foreclosure, and property damage disputes.
The members of the firm have extensive jury trial experience. Although the firm does not believe that every case is appropriate for resolution by trial, the firm does not hesitate to take appropriate cases to trial, and does try cases on a regular basis.
